GENERAL INFORMATION



The United States Department of Transportation requires all hazmat property motor carriers operating under a federally-issued U.S. DOT number to apply for and keep current the Hazmat Safety Permit as specified in the Code of Federal Regulations CFR Title 49 Part 385.405.

Failure to comply with CFR Title 49 Part 385.405 may result in deactivation of your USDOT number and maximum civil penalties of up to $77,114, except where violations result in death, serious illness, or severe injury, as well as substantial destruction of property, for which the maximum civil penalty is $179,993.

WHO IS REQUIRED TO OBTAIN AND RENEW HM PERMIT?



The United States Department of Transportation Hazmat Permit Registration or Renewal is a federal requirement pertaining to and required of all entities operating under a federally-issued U.S. DOT Number who are required to obtain a Hazardous Materials Safety Permit (HMSP). as specified in 49 CFR 385.403.


Do I Need to Register for or Renew Hazmat Permit?
The motor carrier may not engage in transportation of the following materials and its quantities unless they obtain and renew Hazmat Permit:

  • RADIOACTIVE MATERIALS
    A highway route-controlled quantity of a Class 7 (radioactive) material, as defined in 49 CFR § 173.403

  • EXPLOSIVES
    More than 25 kg (55 pounds) net weight of a Division 1.1, 1.2, or 1.3 (explosive) material or articles or an amount of a Division 1.5 (explosive) material requiring placarding under 49 CFR part 172;

  • TOXIC BY INHALATION MATERIALS IN HAZARD ZONE 'A'
    More than one liter (1.08 quarts) per package of a “material poisonous by inhalation,” as defined in 49 CFR § 171.8, that meets the criteria for “hazard zone A,” as specified in 49 CFR § 173.116(a) or § 173.133(a);

  • TOXIC BY INHALATION MATERIALS IN HAZARD ZONE 'B'
    A “material poisonous by inhalation,” in a “bulk packaging,” both as defined in 49 CFR § 171.8, that meets the criteria for “hazard zone B,” as specified in 49 CFR § 173.116(a) or § 173.133(a);

  • TOXIC BY INHALATION MATERIALS IN HAZARD ZONE 'C'
    A “material poisonous by inhalation,” as defined in 49 CFR § 171.8, that meets the criteria for “hazard zone C,” or “hazard zone D,” as specified in 49 CFR § 173.116(a), in a packaging having a capacity equal to or greater than 13,248 L (3,500) gallons; or

  • METHANE
    A shipment of methane (compressed or refrigerated liquid), natural gas (compressed or refrigerated liquid), or any other compressed or refrigerated liquefied gas with a methane content of at least 85 percent, in bulk packaging having a capacity equal to or greater than 13,248 L (3,500 gallons).

The Hazmat Permit (HMSP) is required when any of the substances or their quantities as described above are transported in interstate (cross state lines or transport goods originating from or with a destination outside of the home state) or intrastate (within home state boundaries) commerce.



Hazmat Safety Permit vs. Hazmat Certificate of Registation

It is important to differentiate between Hazmat Safety Permit (HMSP), and the PHMSA Registration (Certificate of Registration).
All companies which are required to obtain Hazmat Safety Permit from Federal Motor Carrier Safety Administration (FMCSA) are also required to have Certificate of Registration (PHMSA Registration). The Hazmat Permit is renewed every two (2) years, whereas the Certificate of Hazmat Registration is required to be re-filed annually, or based on the period of registration (one, two, or three years).

State Regulations vs. Federal Regulations

Some states may require a hazmat motor carrier to obtain separate special State permits or licenses and or to register with the particular State(s). Note that State regulations requirements do not exempt companies from obtaining federally regulated permits and registrations such as Hazmat Safety Permit and Certificate of Registration. Therefore, all motor carriers operating under the U.S. DOT number are subject to all federal regulations pertaining Hazmat Motor Carriers and other U.S. DOT and FMCSA regulations.




WHEN MUST HAZMAT SAFETY PERMIT (HMSP) BE RENEWED?


The HMSP must be renewed every two years, according to the carrier’s DOT number as stated in 49 CFR §390.19. To determine your filing period locate the last 2 digits of your U.S. DOT number. The last digit indicates the month when the filing must take place. The second-to-last digit indicates the year when the filing must be completed (an odd number mandates a filing in an odd year and an even number mandates a filing in an even year).

EXAMPLE:
U.S. DOT number '384967' ends in the digit '7' which corresponds to the seventh month of the year, July. The second-to-the-last digit is '6' which is an even number which correspond to an even year. As such, this motor carrier must file their update in July of even-numbered years. Note that the last digit corresponds to the months 1-9 (January - September) while 0 indicates the month of October. No filings are scheduled for November and December. The Hazmat Permit (HMSP) must be renewed within the 60-day period before its expiration date, and not earlier than 60 days ahead of the expiration date.

This form is used to inform the Department of Transportation of changes in the company structures or contact information and to file the Hazmat Carrier Biennial Update as well as to renew and apply for Hazmat Permit. Additionally, as part of this application you may request a Hazmat Certificate of Registration, which you'll have an option to in the application below.
